Terms of Service (Platform)

1. Acceptance of Terms

By accessing or using the FlowCastle platform and dashboard (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. The Service

FlowCastle is a visual no-code/low-code platform for building, deploying, and managing chat bots and automation flows, which may include integrations, broadcast tools, live chat, and analytics.

3. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes.

4. Customer Data

You may upload or connect data and content to the Service, including information relating to your end users ("Customer Data"). You represent that you have all rights and permissions necessary to provide Customer Data to FlowCastle and to allow FlowCastle to process it to provide the Service.

5. Acceptable Use

You are solely responsible for all content your bots send. FlowCastle only transmits it on your behalf and does not review it in advance. You confirm that you have the rights to use the content and that it is legal in every country where your bot has users.

You agree not to use the Service to:

  • Send spam or unlawful bulk messages, or message users without required consent
  • Violate any applicable laws, regulations, or third-party platform rules
  • Infringe or misappropriate intellectual property or other rights
  • Distribute malware, engage in phishing, or attempt unauthorized access
  • Interfere with or disrupt the Service, including by abusing rate limits
  • Create, store, send, or distribute any content that sexually exploits or depicts minors. We report such content to law enforcement and child-protection hotlines, without exception
  • Create, store, send, or distribute pornographic or sexually explicit content
  • Share intimate imagery without the consent of the people shown
  • Show or promote violence, terrorism, or self-harm
  • Violate the Telegram Terms of Service or the rules of any other connected platform

6. Subscriptions and Billing

Some features may require a paid subscription. If you purchase a subscription, you agree to pay the fees and applicable taxes. Payment processing may be handled by third-party processors (for example, Stripe). Subscription terms, renewals, and cancellation details may be presented at checkout or in the dashboard.

7. Third-Party Services

The Service may integrate with third-party services (for example, messaging channels and apps). Your use of third-party services is governed by their terms and policies, and FlowCastle is not responsible for third-party services.

8. Intellectual Property

FlowCastle and its licensors own the Service, including software, design, and trademarks. Subject to these Terms, FlowCastle grants you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes. You retain ownership of your Customer Data.

9. Service Continuity and Data Access

FlowCastle is an actively operated service. We use commercially reasonable efforts to keep the Service available, reliable, and maintained.

If we plan to materially discontinue platform operations, we will use commercially reasonable efforts to notify active customers in advance and provide a reasonable opportunity to export Customer Data and flow configuration where technically feasible. This does not limit suspensions required for security, legal, non-payment, or abuse reasons.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service if you violate these Terms or if needed to protect the Service, FlowCastle, or others.

If we believe these Terms or the law have been violated, we may at any time and without prior notice remove content, stop a bot, suspend or delete a workspace, and refuse refunds. We may preserve related data and disclose it to law enforcement, courts, or child-protection hotlines when required by law or when we reasonably believe a crime has been committed.

To report illegal or abusive content on a bot hosted by FlowCastle, email abuse@flowcastle.ai. We act on valid reports promptly.

11. Service Commitments and Disclaimers

We will use commercially reasonable efforts to provide the Service with professional care and maintain the platform. Except for commitments expressly stated in these Terms or required by law, we do not make additional warranties about uninterrupted availability, error-free operation, or specific business outcomes.

12. Limitation of Liability

To the maximum extent permitted by law, FlowCastle will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill. Our total liability for any claim will not exceed the amounts you paid to FlowCastle for the Service in the twelve (12) months before the event giving rise to the claim.

You will indemnify FlowCastle against any claims, fines, penalties, and costs (including legal fees) arising from content you or your bots send through the Service or from your violation of these Terms.

13. Changes

We may update these Terms from time to time. We will post the updated Terms in the Service and update the "Last updated" date. Continued use of the Service means you accept the updated Terms.
